APPLICATION FORM with
your method of payment.
- For Massachusetts residents add the
appropriate sales tax to the subtotal,
unless exempt documentation is provided
prior to shipment.

Opening an Account:
Its easy to open an account with Dalton & Associates,
Inc. Fill out the CREDIT
APPLICATION FORM and
fax back to us at (888) 221-0477. We can
generally open an account within several
hours, allowing the placement of purchase
orders. For your convenience, along with
checks, we also accept the following credit
cards;

- Master Card
- American Express
- Discover
Terms:
Acceptance of orders; Contrary terms;
Acceptance of buyers order is conditioned upon
buyers assent to the following terms
and conditions, and any inconsistent provision
of any purchase order or other writing shall
not constitute a part of the contract of
sale. If any of these terms and conditions
are not acceptable to Buyer, Dalton & Associates,
Inc. must be notified promptly.
PRICING & SPECIFICATIONS:
All prices in the Dalton & Associates,
Inc. catalog or electronic media,
reflect the Buyers net cost in
U.S. currency. The prices do not include
freight, applicable federal, state, and
local taxes, charges, and duties, or
special crating requirements for shipment
or export. Buyer shall pay all such costs,
taxes, charges, and duties. Prices, colors,
and specifications are subject to change
without notice. The minimal order accepted
is $100.
PAYMENT TERMS: Open
account terms of 2% 10 Days, Net 30 Days
after shipment are extended to firms
listed and satisfactorily rated by Dun
and Bradstreet. Un-rated or unlisted
firms are requested to pay in advance
or by credit card for their first initial
order. Once the purchaser's credit application
has been processed as satisfactory, an
open account status will be recognized.
Late fees of 1-1/2% per month on unpaid balances
will apply after 30 days from invoice date.
EXCLUSIVE WARRANTY:
All products are warranted by the manufacture
to the extent of the manufactures express
warranties. Dalton & Associates,
Inc. or any of its subsidiaries shall
not be liable, under any circumstances,
for consequential or incidental damages,
including, but not limited to labor costs
or loss of profits arising in connection
with the use of or inability to use products
purchased from Dalton & Associates,
Inc. or any of its subsidiaries or contractors.
SHIPPING: All items
ship promptly from factory stock (usually
within 7 to 10 working days). All items
ship FOB Shipping Point, unless otherwise
requested by Buyer. Goods will be shipped
via carriers of our choice with shipping,
handling, and packaging charges prepaid
and added to the invoice. Any extra charges
for services requested by Buyer, i.e.,
special routing, inside delivery, or
pre-delivery notification must be paid
by consignee.
DAMAGED SHIPMENTS; RISK
OF LOSS: Buyer should thoroughly inspect
all items for shipping damage before
accepting delivery. If damage has occurred,
Buyer should note the extent of the damage
on the delivery receipt. Do not sign
the delivery receipt unless this is noted.
Concealed damage must be reported within
72 hours from receipt of goods. The consignee
must make claim directly and promptly
to the carrier for any damage. When damage
is not discovered until all of the items
are unpacked, a request must be promptly
submitted to the carrier for concealed
damage inspection and adjustment. Dalton & Associates,
Inc. responsibility for loss and
damage ceases when the products are accepted
for shipment by the carrier.
RETURNED GOODS:
Are not accepted unless written authorization
has been given by Dalton & Associates,
Inc. and will be subject to manufactures
restocking charges and refurbishing charges
plus freight charges to and from distribution
or manufacturing points. Specials or
modified equipment are NON-RETURNABLE.
Return of goods MUST be within the first
30 days from original shipment date.
All returns are subject to inspection,
any missing or damaged equipment will
be refused. A restocking charge of 20%
will be assessed.
CONTROLLING LAW: The
validity, construction and
enforcement of the purchase
agreement between Dalton & Associates,
Inc. and Buyer shall
be governed by and interpreted
under the laws of the State
of Massachusetts.
